Patent litigation
What happens if your patent is infringed?
A patent gives the owner the exclusive right to use, produce and market the patented product or method. If you believe a competitor is infringing your patent, you may take action to stop them, e.g., by seeking an interim injunction. It is important to quickly collect supporting evidence. Whether the alleged infringer has in fact infringed the patent depends on an interpretation of the scope of the patent claims and will ultimately be determined by the national courts. This is done through patent litigation.
What is the purpose of patent litigation?
The purpose of patent litigation is to ask the court to stop the infringement and potentially be awarded compensation. The subject matter of a patent dispute can be anything from production and sale to import of patented products.
Successful patent litigation requires both technical insight and in-depth experience with legal argumentation as the court will assess the scope and validity of the invention. High-quality legal advice is therefore crucial in patent disputes.
