Expert Witnesses / Court-appointed Experts in patent disputes

Dragsted Partners have extensive experience in acting as technical expert witnesses in patent disputes.

In some legal proceedings, a person with specialist knowledge ̶ a technical expert witness ̶ is needed to assist the court in understanding complex technical or patent law matters, such as technological details, patent scope and the background to the issue of the patent, i.e., issues that may be central to the dispute.

As technical expert witnesses, Dragsted Partners contribute with our technical background and patent law expertise, including second opinions, explaining complicated technical and patent details to the judges.

In that way, we provide the court with a better basis for assessing technical or patent-related parts of the dispute that are beyond the knowledge of the court.

When are technical expert witnesses needed?

Expert witnesses differ from lay witnesses in that they do not testify about facts they have personally observed or experienced; they contribute with specialist knowledge within a specific field, translating and converting technical or specialist information into language that legal professionals without relevant background knowledge can understand.
In a patent dispute, an expert witness may answer questions such as:

  • How a specific technology works
  • How to understand a patent claim in view of the patented technical solution
  • Whether certain technical functions correspond to those described and protected by a patent
  • How to understand patent law issues

As expert witnesses, we draw on our professional IP experience and specialist expertise, enabling us to outline and clarify documents and other material produced in court, provide professional assessments and clearly explain complex issues in terms that are understandable to the court.

With many years of experience in the field of patents and patent law, Dragsted Partners have gained substantial experience in handling the issues that may arise in patent disputes.

When are court-appointed experts needed?

They are appointed by a Danish court and differ from lay witnesses in that they must provide unbiased evidence and not testify to what they have observed or experienced in the case at hand but rather provide insight based on their expertise and experience. A court-appointed expert will be asked to answer specific questions from the lawyers representing the parties to the case, contributing with his or her specialist knowledge within a specific field, typically in the interface between patent law and a particular technical area.

In a patent dispute, a court-appointed expert may answer questions such as:

  • How a specific technology works
  • How to understand a patent claim in view of the patented technical solution
  • Whether certain technical functions correspond to those described and protected by a patent
  • How to understand patent law issues

As court-appointed experts, we draw on our professional IP experience and specialist expertise in technology and patent law, enabling us to outline and clarify documents and other material produced in court, provide professional assessments and clearly explain complex issues in terms that are understandable to the court.
