Trademarks, copyright and design rights

Strategic trademark, copyright and design protection

Strong intellectual property rights are essential for protecting a company’s identity, creative assets and visual expression. Dragsted Partners advise on trademark, copyright, and design protection, three key areas of intellectual property that collectively strengthen brand value, market position and commercial opportunities.

Dragsted Partners assist clients with every aspect of IP management, from developing clear and robust IP structures to registering, enforcing and handling portfolio management across jurisdictions. Whether protecting a distinctive brand, safeguarding original works or securing design rights, our goal is to create intellectual property assets that support business strategies and provide certainty in clients’ day-to-day operations.

Trademarks

A trademark protects a company’s name, logo or other distinctive signs, preventing competitors from using similar branding and safeguarding the company’s market identity.

By registering a trademark, the owner obtains the exclusive right to use the mark in connection with the goods and services for which it is registered. Registration can be obtained at the national, European or international level, depending on the company’s markets and business objectives.

An effective trademark strategy requires both legal expertise and a thorough understanding of the market to avoid conflicts with existing marks. Dragsted Partners help companies identify which brand assets are best suited for protection and determine how to structure that protection to support long-term business objectives. Our services include everything from clearance searches and trademark registration to dispute management and ongoing portfolio maintenance, focusing on establishing a strong and practical trademark strategy that aligns with the company’s commercial goals, mitigates legal risk and secures effective and durable protection for the core elements of its brand.

Copyright

Copyright protects original creative works such as text, software, images, music and designs without requiring registration. Protection arises automatically as soon as the work is created and grants the author the exclusive right to determine how the work is used and distributed. Copyright can be enforced against unauthorized copying, sharing or commercial exploitation of the work.

Dragsted Partners’ team of patent attorneys and patent paralegals advise on how intellectual property rights can best be documented, exploited and enforced, ensuring that clients are in a strong position when/if content is used internally or shared with partners. Our services include licensing agreements, rights clearance (identifying, locating and obtaining permission from authors or rights holders before using their material in a company’s own products), dispute resolution and strategic advice on commercial exploitation. Our goal is to provide clarity and confidence within this complex area of law and to ensure that the value of clients’ creative investments is preserved.

Designs

A design may be registered for any industrial product or handicraft item, including packaging, graphical symbols, typographies, etc.

Design protection is the protection of the appearance of a product – unlike a patent which protects the technology behind the product. It is important to consider design filing as a complement to patent filing and to coordinate those filings.

Dragsted Partners have extensive experience in handling design protection in both Denmark and the EU, and other markets, often coordinating design filings with filings for patent protection of one or more products.
